Chapter 23.02 PERMIT APPLICATIONS--CONTENTS, PROCESSING AND TIME LIMITS
23.02.039 Effective date of land use permit for an appealable project.
(a) A decision by the county on an appeal (Section 23.01.042), variance
(Section 23.01.045), minor use permit (Section 23.02.033) or development plan
(Section 23.02.034), or for a project that is appealable to the coastal
commission pursuant to Section 23.01.043 shall become effective after the ten
working day appeal period to the commission has expired unless either of the
following occur:
(1) An appeal is filed in accordance with Section 13111 of
Title 14 of the California Administrative Code;
(2) The notice of final
county action does not meet the requirements of Section 23.02.036.
(b) When
either of the circumstances in this section occur, the coastal commission shall,
within five calendar days of receiving notice of that circumstance, notify the
county and the applicant that the effective date of the county action has been
